What kind of damages can you recover for when you are injured?

When you are involved in a car accident, you can collect payments for your bodily injury. Most of us have heard the terms pain and suffering. However, the law has divided damages into different categories.

When seeking compensation for injuries, you are really seeking “compensatory damages”. Compensatory damages objective is to put the injured party back in the position they would have been if the accident never happened.

There are two kinds of compensatory damages (actually there are more but when dealing with injury claims these are the pertinent ones). They are special damages and general damages. Compensatory Special damages are all those where you could have a receipt for (medical bills, wages, medicine, etc.) and General Damages are those that you cannot document their value or if you can then it would be a very complicated process (pain and suffering, diminished quality of life, loss of earning capacity).

General damages are usually where lawsuits and disputes with insurance companies occur. Since they are subjective evaluations, then the dispute over their value is almost eminent in every bodily injury claim.
