Permanent injury, How Much?

Permanent injuries are not difficult to identify (you have a broken bone), but their value could be very hard to determine. Many injury lawyers will tell you that you must have legal advice before attempting to settle their value. The question then becomes, does the attorney decides what your permanent injury is worth? Or does the adjuster have a definite answer?

The only people that can ultimately decide is a jury. Your injury is not worth what you or the adjuster think, but what a panel of 12 would decide. Of course, before you get to that level you need an attorney (and so does the insurance company). So in the mean time you will be playing a guess game. The adjuster is guessing as much as you are when evaluating your injury. So do not let an adjuster tell you that their evaluation is set on stone as they have no real idea of what could come up.

The best way to anticipate what you could get is by talking to an attorney or by researching similar cases in your jurisdiction. Look for similar injuries and what juries have awarded. This is the best way to have an educated guess about the value of our injury. Of course, this is only an estimate; your case could be worth much more if there are aggravating circumstances.
