Is the total loss process fair?
Nope, it sure it’s not. The total loss process has been so manipulated by insurance companies to be completely cumbersome and difficult to understand. Also, since most states have allowed for statutes that can put you out of a rental car in as low as one day (Texas), then insurance company has the negotiation already on the bag.
It’s not fair to begin with, but insurance companies not only make it unfair, they also use dirty tactics to get lower settlements and save money to their investors.
Yesterday we posted our view on extra equipment (new tires) and other things that are covered by insurance in the total loss process, but often times total loss adjusters “forget” to add that value or would tell them everyone that it Is not owed. If you are in this case, ask for it on writing. Make sure that if they are quoting the law that they quote that. So you have more information when either documenting a bad faith lawsuit (if it is against your own insurance company) or presented a complaint against the office of the insurance commissioner.
